ACKNOWLEDGEMENT OF RECEIPT OF PRIVACY NOTICE

Under the Health Insurance Portability and Accountability Act of 1996 (hereafter, “HIPAA”), you have certain rights regarding the use and disclosure of your protected health information (hereafter, “PHI”).   

 MY PLEDGE REGARDING HEALTH INFORMATION:

Hoda Counseling LLC (“we,” “our,” or “us”) is committed to protecting your privacy and maintaining the confidentiality of your personal information. This Privacy Policy explains how information is collected, used, and safeguarded when you visit this website.

Hoda Counseling LLC is a licensed mental health practice operating in the State of Oregon that complies with applicable federal and Oregon privacy laws, including the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and relevant Oregon confidentiality statutes.

We understand that health information about you and your health care is personal. We are committed to protecting health information about you. We create a record of the care and services you receive from me. We need this record to provide you with quality care and to comply with certain legal requirements. This notice applies to all of the records of your care generated by this mental health care practice. This notice will tell you about the ways in which we may use and disclose health information about you. We also describe your rights to the health information we keep about you, and describe certain obligations we have regarding the use and disclosure of your health information. 

We are required by law to:

  • Make sure that PHI that identifies you is kept private.

  • Give you this notice of my legal duties and privacy practices with respect to health information.

  • Follow the terms of the notice that is currently in effect.

  • We can change the terms of this Notice, and such changes will apply to all the information we have about you. The new Notice will be available upon request, in our office, and on our website.

Information We Collect

1. Information You Voluntarily Provide

When you complete a contact form, request a consultation, or otherwise communicate with us, we will collect personal information from you such as personally identifying information, contact information, insurance details, the reason you are seeking counseling, and any information you choose to include in your message. Submission of this information is voluntary but may be required in order for us to provide services to you. Please note that contact forms and email are not secure methods of communication for sharing sensitive health information. We will not share this information, but unauthorized individuals may be able to access the information.

Automatically Collected Information

Our website platform, Squarespace, may automatically collect limited technical data, such as:

  • IP address

  • Browser type

  • Device type

  • Pages visited

This information is used for general website functionality and analytics purposes and is not used to personally identify visitors.

Use of Information

Information collected through this website may be used to:

  • Respond to inquiries

  • Schedule consultations

  • Provide information about services

  • Improve website functionality

  • Comply with legal and ethical obligations under Oregon and federal law

We will carefully safeguard your personal information. We will not sell, rent, or trade your personal information.

We may use or disclose your information only as permitted or required by HIPAA and applicable law, including for treatment, payment, healthcare operations, or when necessary to protect safety or comply with legal obligations. Any disclosure is limited to the minimum necessary.

Federal privacy rules (regulations) allow health care providers who have direct treatment relationship with the patient/client to use or disclose the patient/client’s personal health information without the patient’s written authorization, to carry out the health care provider’s own treatment, payment or health care operations. I may also disclose your PHI for the treatment activities of any health care provider. This too can be done without your written authorization. For example, if a clinician were to consult with another licensed health care provider about your condition, we would be permitted to use and disclose your PHI, which is otherwise confidential, in order to assist the clinician in diagnosis and treatment of your health condition. I may also use your PHI for operations purposes, including sending you appointment reminders, billing invoices and other documentation.

Disclosures for treatment purposes are not limited to the minimum necessary standard. Because therapists and other health care providers need access to the full record and/or full and complete information in order to provide quality care. The word “treatment” includes, among other things, the coordination and management of health care providers with a third party, consultations between health care providers and referrals of a patient for health care from one health care provider to another.

Confidentiality & HIPAA Compliance

If you become a client of Hoda Counseling LLC, your protected health information (PHI) is governed by a separate Notice of Privacy Practices, which you will receive as part of the intake process.

As a licensed provider in Oregon, we comply with:

  • Applicable federal privacy and confidentiality laws including, HIPAA (45 CFR Parts 160 and 164)

  • Oregon laws governing confidentiality of mental health records

  • Ethical standards set forth by the Oregon Board of Licensed Professional Counselors and Therapists

These laws provide strict protections regarding the use and disclosure of your health information.

Electronic Health Records & Client Portal

Hoda Counseling LLC uses SimplePractice as its electronic health record (EHR), scheduling, billing, and primary secure client portal platform.

SimplePractice is a HIPAA-compliant service provider and maintains administrative, physical, and technical safeguards designed to protect client information. If you become a client, you will access documents, billing, and secure messaging through the SimplePractice client portal.

SimplePractice maintains its own privacy and security policies, which are available through its website.

Age Requirement

Services provided by Hoda Counseling LLC are limited to individuals 18 years of age and older.
We do not knowingly collect personal information from individuals under 18 years of age through this website.

Data Security

We implement reasonable administrative, technical, and physical safeguards to protect personal information. However, no method of transmission over the internet is completely secure.

If you need to share sensitive clinical information, please contact the office directly by phone.

Third-Party Services

We may use third-party providers for:

  • Website hosting

  • Email services

  • Payment processing

  • Electronic health records, practice management, and videoconferencing services (SimplePractice)

  • Videoconferencing services (Doxy.me, used as a backup platform if needed)

These providers maintain their own privacy and security standards. We limit information shared with third parties to what is reasonably necessary to provide services.

Oregon-Specific Privacy Rights

Under Oregon law, clients have rights regarding access to and correction of their clinical records, subject to limitations established by law and professional standards.

Questions regarding access to clinical records should be directed in writing to Hoda Counseling LLC.

Changes to This Policy

This Privacy Policy may be updated periodically to reflect changes in legal requirements or business practices. Updates will be posted on this page with a revised effective date, and also available in my office.
